Under rule 11(b)(3) of the Federal Rules of Civil Procedure, any lawyer, upon signing any pleadings, motions and other papers, represents to the court that "the allegations and other factual contentions have evidentiary support. . . ."
Clearly, Daschles complaint didn't have a shred of evidentiary support. If I were Thune, I'd motion for sanctions as payback for wasting my time.
